NixBlox Beta Program Terms

These Beta Program Terms ("Beta Terms") are an agreement between you and NixBlox LLC, a Michigan limited liability company ("NixBlox," "we," "us"). They govern your participation in the NixBlox beta program, including beta access to the NixBlox Designer desktop application, the org portal at app.nixblox.app, and the cloud services that support them (together, the "Beta Services").

These Beta Terms supplement the NixBlox End User License Agreement (which governs use of the desktop software), the Terms of Service (which govern the websites and cloud services), and the Privacy Policy (which describes how we handle information). If these Beta Terms conflict with those documents on a topic specific to the beta program, these Beta Terms control during the beta.

By checking the acceptance box during signup or activation, you agree to these Beta Terms. If you are accepting on behalf of an organization, you confirm that you are authorized to bind that organization, and "you" includes that organization.

1. Acceptance and Our Records

Participation requires affirmative acceptance of these Beta Terms. When you accept, we record the acceptance: which agreement and version you accepted, your name and email, your organization and role (when applicable), whether you accepted personally or on behalf of an organization, the date and time (UTC), your IP address and browser/device information, and where the acceptance occurred (for example, the organization portal). These records are retained as described in the Privacy Policy and are kept to document the agreement between us. You may request a copy of your accepted terms at any time at support@nixblox.app.

If we materially change these Beta Terms, we will publish a new version and prompt you to accept it before continued use of the applicable Beta Services.

2. Beta Access

Beta access is provided at our discretion, free of charge unless otherwise stated, for the purpose of evaluating and improving NixBlox products.

3. Beta Software — Expectations and Your Data

The Beta Services are provided "AS IS" and may contain errors. Features, file formats, and cloud services may change or be discontinued without notice, and we make no commitment regarding availability, data retention, or migration of beta data (EULA §7–§9 and Terms of Service §7, §9–§10 apply).

Do not make the Beta Services the only home of critical data. The desktop application keeps local files; keep your own backups of projects and exported deliverables. Cloud storage during the beta is a convenience and collaboration layer, not a system of record.

Design output produced with NixBlox tools must be verified by a qualified professional before use for procurement, installation, or construction (EULA §4).

4. Confidentiality of Unreleased Features

The beta program may expose you to features, designs, documentation, roadmaps, pricing concepts, and performance information that NixBlox has not made public ("Beta Confidential Information"). You agree to keep Beta Confidential Information confidential, to use it only to participate in the beta program, and not to disclose it publicly (including in reviews, posts, screenshots, or videos of unreleased features) without our written permission. This obligation ends when the information becomes public through no fault of yours, and it survives the end of your participation for two (2) years. Your own Customer Content is not Beta Confidential Information.

5. Feedback

We ask beta participants for feedback — bug reports, suggestions, feature requests, and impressions. You are not required to provide feedback, but if you do, NixBlox may use it freely to improve and develop its products without restriction, attribution, ownership transfer, or any obligation of compensation to you. Feedback does not include your Customer Content.

6. Ownership; What We Collect During the Beta

You own your work. You (or your organization) retain all rights to the projects, designs, drawings, bills of material, and other content you create with or store in the Beta Services ("Customer Content"), as provided in the EULA and Terms of Service. NixBlox claims no ownership of Customer Content.

We own the product. NixBlox retains all right, title, and interest in the application, source code, architecture, workflows, documentation, branding, updates, analytics systems, and product improvements, including improvements made during or arising from the beta program.

Diagnostics and usage data. To operate and improve the Beta Services, we collect diagnostic, performance, security, and feature-usage data as described in the Privacy Policy. NixBlox owns aggregated or de-identified analytics and product insights derived from use of the Beta Services; these never include your Customer Content in identifiable form.

Product library ("learns products, never projects"). Some beta features extract facts about commercial products (for example, when you paste a manufacturer's product page URL, the service may extract the product's model, part number, and specifications). Product facts extracted this way may be stored in a shared product library that benefits all NixBlox users. This library contains vendor product information only — it never contains your project designs, drawings, customer information, or any content identifying your organization's work.

7. Your Responsibilities

You agree to: use the Beta Services under the EULA and Terms of Service (including the Acceptable Use rules); keep your account email current (license keys and invitations are bound to email addresses); and report security issues you discover to support@nixblox.app rather than exploiting or publicizing them.

8. Term and Ending Participation

You may leave the beta program at any time by stopping use and uninstalling the software. We may suspend or end your participation at any time, including if required agreements remain unaccepted, if the program ends, or as provided in the EULA and Terms of Service. Sections 4, 5, and 6 survive the end of your participation. The end of beta participation does not delete your local files — locally stored Customer Content remains yours.

9. General

These Beta Terms are governed by the laws of the State of Michigan, without regard to conflict-of-laws rules; the state and federal courts located in Wayne County, Michigan have exclusive jurisdiction over disputes arising from them. The warranty disclaimers and liability limits in the EULA (§8–§9) and Terms of Service (§9–§10) apply fully to the Beta Services, including the US $50 aggregate cap where nothing was paid. These Beta Terms, together with the EULA, Terms of Service, Privacy Policy, and Refund Policy (as applicable), are the entire agreement regarding the beta program.
